Sanbornton boat owner facing legal action after guest's broken neck

LACONIA — A Charlestown, Massachusetts man is suing a boat owner for negligence after suffering a broken neck and paralysis sustained from diving off his boat on to the Sanbornton sandbar in Lake Winnisquam on Sept. 1, 2013.

Samual Brown makes the case that he was invited to the Sanbornton home of Hugh Shaffer by Shaffer's daughter, where he was told the plan was to boat, then swim at a sandbar, a popular swimming and boating stop on the lake, reports the Laconia Daily Sun.

Brown had never been to the sandbar before, according to paperwork.

Brown claims he was asked to help with the anchor even though he had no knowledge or instruction of how to do so from Shaffer. He alleges that Shaffer told him he could dive off the front of the boat when it slowed, where he hit the sandbar.

Brown claims Shaffer was negligent in letting him dive off the moving boat, and is suing for injuries suffered, past and future medical bills, emotional distress, pain and suffering, and loss of enjoyment of life, and loss of opportunity, along with attorney fees and court costs.
