Prosecutors: Hampton toddler found dead had access to open container of fentanyl
A Hampton man is being held on $25,000 cash bail in connection to the death of his 19-month-old stepson.
Leo Witham, 30, of Hampton was arraigned in the 10th Circuit District Court in Seabrook on Tuesday morning. Witham is charged with misdemeanor child endangerment, as well as possession of a controlled drug and falsifying physical evidence, both felonies, in connection to the death of the toddler last Wednesday.
According to police, Witham brought the child to the Hampton Fire Department after noticing he was unresponsive.
Upon investigation, the police found an open container of fentanyl at Witham's residence where he and the child lived. Prosecutors said the deadly drug was accessible to the toddler.
Police also found a bottle of Lorazapam Witham allegedly concealed under a blanket on the child's bed.
Hampton Police said the cause of the child's death is still under investigation. An autopsy has been conducted, and there is no direct connection between the death and the open container of fentanyl.
Prosecutors said depending on the cause of death, more severe charges could be filed against Witham.
Witham was arrested on Friday in Massachusetts. He is being held at Rockingham County Jail. He is due back in court on Oct. 19 for a probable cause hearing.
