Police: Gun taken after fight breaks out in Mall of NH over marijuana payment

MANCHESTER — A Derry man refused to pay for marijuana sold to him by a Boston man, leading to a fight inside the Mall of New Hampshire, police said.

Officers were called to the area of Old Navy for the altercation between Justin Choice, 22, and Garrett Clay, 20. Choice allegedly sold marijuana to Clay the day before and never received payment, which led to the confrontation.

Clay told the officers he refused to pay for the marijuana. Choice recognized Clay at the mall and allegedly punched him several times.

Choice said that Clay pointed a handgun at him during the fight, which officers were unable to prove.

He was armed with a .380 handgun and did not have a concealed carry permit. The handgun was taken and placed into evidence for safekeeping.

Choice was charged with three counts simple assault and conspiracy to commit sales of a controlled drug. He was released on $1,000 cash/surety bail and is scheduled to appear in court on Dec. 20.

Clay was charged with conspiracy to commit possession of a controlled drug and carrying a firearm without a license. He was released on $1,000 cash/surety bail and is scheduled to appear in court on Nov. 30.
