Pembroke man acquitted of rape charges

CONCORD — A jury has acquitted a Pembroke man of rape after he served part of a 15-year prison sentence.

Marcario Sanchez was accused of raping a young girl he once lived with and was convicted of three charges in 2010. A judge nullified the convictions and ordered a new trial after Sanchez's former public defenders reported last year they didn't press the girl about a discrepancy in her account.

The Concord Monitor reports the 35-year-old Sanchez was acquitted Wednesday. Jurors were unable to reach a unanimous verdict on one of the counts. Assistant Merrimack County Attorney Wayne Coull can still move to retry Sanchez on that charge; he didn't immediately respond to requests seeking comment.

Sanchez's new attorney, Mark Sisti, says his client maintained his innocence all along.
