Owen Labrie's lawyer files notice of appeal, taking case to NH Supreme Court


CONCORD - Lawyers for St. Paul's School graduate Owen Labrie filed a notice of appeal on Wednesday, indicating their intention to appeal Labrie's conviction and sentencing to the N.H. Supreme Court.

Lawyer J. W. Carney Jr., will be appealing the decision of Judge Larry Smukler in Merrimack County Superior Court that convicted Labrie of three misdemeanor counts of sexual assault of a then-freshman girl and one felony count of uses of a computer prohibited.

The questions submitted for appeal include whether the trial court erred by not setting aside the verdict relating to the use of the computer to set up a meeting with the girl.

Other questions cover a blanket of appeal issues from the constitutionality of the decision and to whether the trial court erred in admitting certain evidence or whether the prosecutor misstated the evidence in closing arguments.
