NH legalizes fantasy sports with special rules for experienced players


CONCORD — A new law officially makes it legal to play fantasy sports in the Granite State and while it doesn't change a lot, if you are a fantasy sports business, or a frequent player, there are a few things you need to know.

The law allows the state to regulate the way fantasy games are run, but it will not profit from them as a result.

Popular fantasy sports websites DratKings and FanDuel supported and testified in favor of the law.

The law does not affect the average fantasy sports player, but instead, the platform that they are using to participate.

Any organization that wants to participate in the hosting of fantasy leagues created by themselves or players will need to be authorized to do business in New Hampshire. They also will need to register with a state commission through an application process.

Businesses or organizations that were operating fantasy sports services before the new law was signed are allowed to continue as long as they have an application submitted. Those business will only need to cease operations if their application is denied.

As part of the new law, "highly experienced" players who have participated in over 1,000 fantasy competitions, or have won three or more contests with prizes totaling $3,000 or more from the same game operator must be marked. Fantasy game operators would be required to designate these players in a way that other players would be able to see.

Regulations by the state include the ability to audit the operators at any time to make sure each player's funds are being used properly. It also outlines rules for "scripts," or lines of code, that allow for people to automate and sometimes create an unfair advantage over other players.

Anyone participating in the fantasy games must be at least 18 years old.

The bill was signed into law by Gov. Chris Sununu and went into effect on July 18.
