NH judge says Exeter Hospital can demand compensation for payouts to patients

EXETER — A federal judge is allowing Exeter Hospital to demand compensation for payouts to patients who tested negative for hepatitis C in 2012, according to seacoastonline.com.

Hospital attorneys said that Triage Staffing was negligent because the temporary employee David Kwiatkowski injected himself with Fentanyl he stole from the hospital and left infected needles to be used on patients.

Attorneys also claim that the American Registry of Radiologic Technologists were aware of similar cases but failed to revoke Kwiatkowski's license.

More than 3,000 patients were tested, but the amount of settlements reached remains confidential.

The trial date for the case is set for Oct. 23, 2017.
