NH court allows Toyota of Portsmouth to construct driveway during eminent domain case


PORTSMOUTH — James Boyle, owner of Toyota of Portsmouth, has been allowed by the New Hampshire Supreme Court to construct a driveway connecting his Greenleaf Avenue dealership property to the Route 1 Bypass.

Boyle's lawyer, John Kuzinevich, said that the value of Boyle's property "skyrockets" because of this ruling, Seacoastonline said.

The city has recently voted to proceed with an eminent domain taking of 4.6 acres of land in the rear of Boyle's property where a city sewer line runs.

Kuzinevich told Seacoastonline that the city is now exposed to millions of dollars more in "damages" related to the eminent domain taking since this ruling passed.
