Man to plead guilty to giving Atkinson man heroin that led to his death

BRENTWOOD — A plea deal has been made with the man charged with providing a deadly dose of heroin that killed a 22-year-old Atkinson man, according to the Union Leader.

Nicholas Austin, 25, of Newton will plead guilty for his role in Thomas Drake's death on Sept. 7, 2014.

Austin is only one of the two men who were indicted in July for sale of heroin that resulted in death. Feliz Quintero Aguilar, 38, of Boston, faces the same charges and is being sought by the U.S. Marshal's Office.

Austin could have faced up to life in prison before agreeing to the plea deal.

Austin's defense lawyer, Joseph Welsh, argued that police pressured him into providing incriminating information when he participated in a voluntary interview on Sept. 10, 2014.

Austin suggested that at the time of this interview he didn't know his constitutional rights.
