Man found guilty of sexually assaulting 15-year-old after drunken incident at UNH

DOVER — A man who was accused of raping a 15-year-old girl has been found guilty of sexual assault. However, he was found not guilty on charges of aggravated felonious sexual assault and witness tampering.

Leroy Mejia, 20 of Dover, was partying with friends in his dorm room at the University of New Hampshire in 2014 when he engaged in sexual activity with the victim.

Strafford County Attorney Thomas Velardi said the female was too intoxicated to consent to the sexual acts. He added that the age of consent in New Hampshire is 16 so she was also too young to legally consent. Mejia was 18-years-old at the time.

Mejia's defense attorney said in court that there were four other people in the dorm room when the two began having sex, none of which were compelled to stop what was going on.

The victim fell off the of the top bunk due to her level of intoxication. Now bloody, and still suffering from the effects of the vodka she had been drinking, the victim's friends attempted to sneak her out of the dorm. She was seen by a UNH police officer and Durham fire personnel and taken to the hospital for treatment.

Mejia was also charged with two counts of witness tampering for asking another man to withhold information from the police and lie to the victim's father.

Mejia was found not guilty of the aggravated felonious sexual assault which could have meant 20 years in prison. He was also found not guilty of the two counts of witness tampering which could have meant 7 years in prison for each.

He was found guilty of sexual assault.
