Lung cancer patient sues over medical marijuana ID card

CONCORD — An Alstead woman with advanced lung cancer is suing New Hampshire's health commissioner in hopes of getting a medical marijuana identification card before dispensaries are opened.

The Department of Health and Human Services started accepting applications this week from potentially qualifying patients and their caregivers, but identification cards won't be used until the Alternative Treatment Centers get authorization to start dispensing medical marijuana.

Four centers are expected to open early next year, but Linda Horan wants her card now so she can obtain medical marijuana in Maine without fear of being arrested in New Hampshire. Horan, who filed her lawsuit Thursday in Merrimack County Superior Court, says she and other seriously ill people are suffering every day they go without the cards.
