Lawyers: Investigation into expelled Phillips Exeter student 'tainted with gender bias'

EXETER — Lawyers representing a teen expelled from Phillips Exeter Academy for having a sexual encounter with another student maintain that the teen was unfairly punished and received a bias investigation from the academy.

Documents filed with the court claim two 15-year-old students had sex back in January.

Lawyers for the teen maintain that their client was unfairly punished after school administrators allegedly told the suspect's parents that he would be placed on "Dean's Leave" for one semester, but then could return in the fall. The lawsuit said that administrators then changed that decision, and three months later told the parents their son would not be allowed back to the school.

Lawyers also maintain that teen was subjected to an investigation “tainted with gender bias,” the Union Leader reported.

School administrators began investigating an incident when the girl reported that she had been a victim of “sexual harassment or abuse” sometime in January.

A judge presiding over the lawsuit against the school is allowing lawyers for the teen to use the findings of an independent investigator hired by the academy.

The case is scheduled to be tried in U.S. District Court, District of New Hampshire in Concord starting on Nov. 14. It's expected to last five days, ending on Friday, Nov. 18.
