Hampton man arrested for death of 19-month-old waives probable cause hearing

HAMPTON — A Hampton man arrested in connection with the death of his 19-month-old stepson has waived his probable cause hearing.

Police investigated what happened inside a room at the Westport Motel on Ashworth Avenue, after an "unattended death" of Brayden Brewer.

Leo Witham, 30, was arrested in connection to the incident and identified as the child's stepfather.

Further investigation revealed that an open container of fentanyl was in the toddler's reach at Witham's residence where he and the child lived.

Police also found a bottle of Lorazapam Witham allegedly concealed under a blanket on the child's bed.

Hampton Police said the cause of the child's death is still under investigation. An autopsy has been conducted, and there is no direct connection between the death and the open container of fentanyl.

Prosecutors said depending on the cause of death, more severe charges could be filed against Witham.
