First on NH1 News: January shootout with Derry police caught on dashboard camera


DERRY - NH1 News has obtained video of an officer-involved shooting in January that happened in Derry.

The New Hampshire Attorney General's office identified the man shot and killed as 54-year-old Andrew Toto, of Derry.

Police said he died from a single gunshot to the chest.

The video we have is a look at that gun battle from the officer’s dashcam.

The attorney general spelled out the details of what happened the day officer Kevin Ruppel heard the 911 call about a man who was threatening suicide by cop.

The video starts with Toto leading police on a chase through this neighborhood until he pulls into a driveway.

Instead of surrendering, he uses his truck as a shield and starts firing his shotgun.

You can see some of the rounds taking out a patch of ice.

The officer takes cover behind his suv patrol car about 250 feet away.

In the report, the officer describes this gun battle like "whack-a-mole.” He said each man was firing and then ducking for cover.

Once the man stops firing you can see he puts his hands up in the air.

That's when police shoot him.

You can see the officers approaching Toto because they weren't sure if he had been hit.

He was, and he died.

The attorney general ruled this shooting to be justified.
