Ex-Dover hospital employee found not guilty on one sexual assault charge, jury hung on second

DOVER - A former employee of Wentworth-Douglass Hospital in Dover was found not guilty on one sexual assault charge against him last week, but his jury was hung on the second charge.

Brendan Higgins, who was a 41-year-old computer tomography technician at the time of the alleged attack on Sept. 15, 2013, came into contact with his alleged 25-year-old victim after she was admitted to the Dover hospital. Higgins later told police "it wasn't" a mistake when he groped her breasts after a CAT scan, and he was charged with two counts of sexual assault.

Higgins was suspended from his job immediately after the incident, and has not been allowed to return, expect for personal medical treatment.

Now, Deputy County Attorney Alysia Cassotis must determine whether or not re-trying Higgins on the second charge is worth the state's time. NH1 has learned that the jury was very close to declaring Higgins innocence on the second charge as well, voting 10-2 behind closed doors in favor of finding him not guilty.
