Dover man found guilty of sexual assault after intercourse with sleeping teen

DOVER—A man was found guilty of aggravated sexual assault after having sex with an unconscious teenager.

According to County Attorney Thomas Velardi, who prosecuted the case, the victim was a recent Dover High School graduate who woke up to find that John Rothwell, 32 of Dover, was having sex with her, according to Fosters.

Velardi said that the issue at Rothwell’s trial was whether the sexual activity was consensual.

The sexual assault apparently occurred while the victim was sleeping about two feet away from Rothwell’s wife- Rothwell’s defense attorney suggested to the jury that the incident involved a consensual sexual threesome.

Court files indicate that Rothwell claimed to be intoxicated the night of the assault and does not remember what happened.

Rothwell was found guilty in June after a three-day trial and faces 10 to 20 years in prison.
