PORTSMOUTH — The City Council voted 5-2 to take 4.6 acres of land by eminent domain from James Boyle's Toyota of Portsmouth dealership.
The vote happened shortly before 11 p.m. on Tuesday after lawyers for the city and the attorney for Boyle stated their sides of the issue, the Seacoastonline reported.
The rear of Boyle's property includes a city sewer line running from the corner of Greenleaf Avenue to the Route 1 Bypass. Deputy City Attorney said the city needs the land due to the sewer line and for storm water management around the site.
Boyle's lawyer said that the city and Boyle are scheduled to go to court in February. He stated in the public hearing that they will appeal the decision to superior court if the land taking is approved.
