Companies involved in Exeter wrongful death lawsuit deny responsibility


EXETER — Both companies that are being accused of causing the death of a bicyclist acknowledged that a traffic plan was not submitted to the town while work was being done on a construction project, the Union Leader reported.

A wrongful death lawsuit is accusing Martini Northern LLC and Bourassa Construction LLC of negligence that caused Margaret Rugg, 64, her life. Rugg was hit by a garbage truck while riding her bicycle in the breakdown lane along Epping Road in Exeter in July 2015.

Police said that Rugg tried to maneuver through lane closure due to construction when she lost her balance and ended up in the path of a Pinard Waste Systems truck.

The lawsuit states that Martini Northern was the general contractor of the project at 64 Epping Road.

Both construction firms and Pinard Waste Systems Co. Inc. have denied responsibility for Rugg's death. The lawsuit was filed in December by Rugg's brother, James Rugg.

The trial date has been set as March 2017.
