Brother of biker killed in Exeter files wrongful death suit

EXETER— The brother of a woman killed by a garbage truck while she was biking in a construction zone in Exeter has filed a wrongful death suit on her behalf.

James Rugg filed the suit on Dec. 21 in Rockingham Superior Court against Pinard Waste Systems of Hooksett, Martini Northern of Portsmouth and Bourassa Construction of Stratham.

The lawsuit says the three companies were negligent in forcing 64-year-old Margaret Rugg "into a narrow, unsafe area" on Epping Road that resulted in her death on July 22.

Margaret Rugg was biking when she lost her balance and was run over by the back wheels of a commercial trash hauling truck.

A spokesman for Martini Northern declined to comment and attempts to reach Pinard and Bourassa were unsuccessful.
