AG releases final report of January Derry officer-involved shooting


DERRY – The NH Attorney General released a final report Tuesday on the fatal shooting of a Derry man by police in January.

The report announced the officer's use of his weapon was legally justified.

Andrew Toto died from a single gunshot wound to the chest after Toto’s wife called police and claimed he was distraught, armed and suicidal.

When police found Toto’s truck at the intersection of Scobie Pond Road and Julien Road, he began shooting at the officer and the officer shot back.

The final report is a result of a long investigation that includes lab testing, scene investigations and eye witness accounts.

Toto was transported to an area hospital where he died of his injuries.
